BIO

An innovative, strategic, efficient and razor-sharp litigator Sean helps clients with both corporate and employment disputes. Sean’s name is almost synonymous with complex, high-value employment litigation and with good reason too: he has a wealth of knowledge in employment law. He has been recognised multiple times for his work helping businesses with their employment law compliance and disputes. He focuses on advising large corporates, NGOs and senior executives on collective bargaining, employment policies and procedures, performance management, separations and collective terminations, staff contracting and unionization.

He has worked on the staff restructuring/retrenchment/redundancy exercises for various blue-chip companies including UAP Old Mutual Group, Sanlam Kenya Plc, Kenya Orient Insurance, Liberty Life Assurance and Heritage Insurance Kenya, Alios Finance Group, Andela, Eaton Towers, Letshego Holdings Limited, Habitat for Humanity Kenya and Kenya Fluorspar Company Limited among many others. Sean also represents clients in arbitration and has experience in handling international commercial arbitration issues for clients.

EXPERIENCE

  • Emirates National Oil Company Singapore Pte. Ltd: a successful representation in an international arbitration against Kenya Pipeline Company for recovery of the value of lost stocks of petroleum products. The claim arose out of the infamous Triton scandal.
  • Centric Energy (Kenya) Limited (a subsidiary of Africa Oil Corporation): in various judicial review proceedings and appeals before the Court of Appeal concerning its oil exploration rights in Turkana.
  • BOC Kenya Limited: in its challenge against decisions and directives issued by the Capital Markets Authority in connection with the intended 2005 merger between BOC Kenya Limited and Carbacid Investments Limited (now known as Carbacid Investments Plc).

  • An NGO: concerning a suit filed by a former employee seeking relief for salary underpayment, unlawful termination, constructive dismissal and unpaid terminal dues.
  • An insurance company: concerning advice on employee redundancies. Provided definitive advice on the redundancy process and hand-holding through the process and preparation of all documents issued during the process.
  • Ol Pejeta Ranching Limited: in its appeal at the Court of Appeal against an employment award made in favour of a former senior manager. The decision arising from the appeal has become the authority for pay discrimination in Kenya.
