Dispute Resolution


  • A Danish company: in a procurement appeal over a KES 7.9 billion (approximately USD 72 million) claim relating to the construction of a greenfield aviation fuel depot at the Jomo Kenyatta International Airport.
  • A State Client: in its successful defence in a major international commercial arbitration where the claim exceeds USD 600 million (USD 6 million).
  • An International Construction firm: in constitutional and judicial proceedings against the Kenya Revenue Authority.
  • MultiChoice Africa and GOtv: in constitutional proceedings seeking to halt the migration from analogue to digital broadcasting in Kenya.
  • Emirates National Oil Company: a successful representation in an international arbitration against Kenya Pipeline Company for recovery of the value of lost stocks of petroleum products. The claim arose out of the infamous Triton scandal.
  • Centric Energy (Kenya) (a subsidiary of Africa Oil Corporation): in various judicial review proceedings and appeals before the Court of Appeal concerning its oil exploration rights in Turkana.
  • Directors of East Africa Portland Cement Company Limited: in a judicial review claim against the Government following the Government’s interference in the constitution of the board.
  • Ol Pejeta Ranching: in its appeal at the Court of Appeal against an employment award made in favour of a former senior manager. The decision arising from the appeal has become the authority for pay discrimination in Kenya.
  • A leading Kenyan supermarket chain: in successfully challenging a retroactive tax claim by the Kenya Revenue Authority worth over KES 100 million (USD 1 million).
  • Uber: in court proceedings filed by a group representing over 800 drivers in Kenya seeking to challenge the contractual terms between the parties.
  • One of the “Big Four” professional services firms: in procurement proceedings relating to the Standard Gauge Railway project, one of the Kenya government's flagship infrastructure projects with an estimated USD 3.8 billion (approximately KES 414 million) value for the Mombasa – Nairobi phase.
  • MultiChoice Africa (a multinational media and entertainment group): in competition matters before the Competition Authority of Kenya.
  • Japan Export Vehicle Inspection Centre: concerning judicial review and administrative law remedies related to procurement proceedings by Kenya Bureau of Standards and before the Public Procurement Regulatory Authority.
  • East African Breweries (a Kenyan-based beverage company): in the dispute with a local company over the Smirnoff Black Ice with Guarana product.
  • A leading global manufacturer of pharmaceutical products: in landmark constitutional proceedings dealing with property rights in pharmaceutical products.
  • BOC Kenya Limited: in its challenge against decisions and directives issued by the Capital Markets Authority in connection with the intended 2005 merger between BOC Kenya Limited and Carbacid Investments Limited (now known as Carbacid Investments Plc).
